Rates

During the first contact, it will be investigated whether the fees and charges can’t be borne by a third party, such as an insurance company. If this is the case, This third party will be contacted as soon as possible, asking if they want to take all the costs of their expenses.

Fees

Since the 1. January 2014, attorneys are required to charge a VAT of 21 % on the invoiced amounts. The indicative rates listed below are exclusive V.A.T. The listed amounts will be indexed annually and are determined based on the health index of January 2017. For a first and primary advice were the problem situation will be analysed and an approach will be given, a flat-tariff will be charged of € 75,00 /h. Afterwards a basic rate of € 120/h. will be charged. This hourly rate may vary depending on the specialization, the importance, the urgency, the complexity of the case. Appointments will then be made at the start of the collaboration.

Terms & Conditions and Privacy Notice

Terms and Conditions 1. Applicable law and competent court

Underlying terms and conditions apply to the commitments between the lawyer and the client. In case of dispute, Belgian law will be applied. Only the courts of East Flanders, department Ghent will be considered to be the competent courts in case of dispute.

2. Payments

Advances must be paid within the 8 calendar days, final salary statements and costs within 30 calendar days. Hereafter the invoices will be raised without prior notice with a minimum interest of 8% per annum from the invoice date.

The invoice will also be increased by late payment, or non-payment, without prior notice, with a fixed surcharge of 10% per honorary note, with a minimum of 150 € and a maximum of 2,500,00 €. This damages will be due without prejudice to the principal, interest and any court fees.

Insofar as one honorary note / advance is not paid within the mentioned payment periods, all outstanding notes, requested advances are immediately due and the attorney is no longer obliged to provide further services until all outstanding invoices have been paid.

Protest of requested invoices must be reported in writing, within a period of 8 calendar days after the date of invoice. After that, the invoices will be considered as well-founded and accepted.

All amounts received from third parties, for clients, will be transferred in the shortest possible time. The same applies to the money received from the client, to make payments to third parties.

(Der Mandant gibt seine Zustimmung, dass der Rechtsanwalt von den vom Kunden einbehaltene Zahlungen an Dritten die Beträge einziehen darf, die notwendig sind um Honorarrechnungen zu bezahlen.. Der Mandant behält jedoch sein Protestrecht.)

Receipts received on behalf of client may be withheld to pay outstanding invoices. This does not exclude the client's right to protest.

3. Liability

The attorney is insured for his professional liability by a collective insurance policy signed by the Flemish Bar Association. The client accept that the compensation for the damage suffered by the client as a result of a professional error is limited to 1.250.00,00 €/case.
